Quincy man found not guilty in alleged rape case

James E. Green of Quincy was found not guilty of sexual battery and kidnapping last Friday afternoon after a Leon County jury deliberated about an hour.

The case involved a former female friend of Green’s.

The victim claimed, in her trial testimony, that she and Green were only friends, and the incident that took place Dec. 6, 2006, was forced sex and kidnapping, and not consensual sex.

Green’s attorney, Clyde Taylor of Tallahassee, argued in closing statements that the claims of the victim defied all logic and common sense, and the alleged assault could not physically have happened as the victim said.

The state produced DNA evidence to confirm sexual activity. Green did not testify in the case.

Taylor, after the verdict, said he thought the case should never have been pursued, based on the claims of the alleged victim.
