  • 4315-0821 GCT PUBLIC NOTICE IN THE CIRCUIT COURT OF THE SECOND JUDICIAL CIRCUIT IN AND FOR GADSDEN COUNTY, FLORIDA IN RE: FORFEITURE OF: ONE (1) 2006 FORD 500 VIN #1FAFP27166G131181; ONE HUNDRED SIXTY FOUR ($164.00) U.S. CURRENCY COMPLAINT/PETITION FOR JUDGMENT OF FORFEITURE The CITY OF GRETNA, a Florida Municipal Corporation, files this complaint for Order of Probable Cause and for Final Judgment of Forfeiture pursuant to Rule 1.110(b) of the Florida Rules of Civil Procedure and says: 1. This is an action for forfeiture pursuant to the Florida Contraband Forfeiture Act, Florida Statutes Sections 932.701-932.707, and this Court has jurisdiction pursuant to Florida Statutes Section 932.704(2). 2. The Gretna Police Department, an agency of the City of Gretna, is a "law enforcement agency" and a "seizing agency" as those terms are used in Section 932.704, Florida Statutes. 3. The property which is the subject of this action is One Hundred and Sixty Four Dollars in United States Currency ($164.00) and one (1) 2006 Ford F500 vehicle. 4. The property described in Paragraph 3 above was, on or about March 18, 2014, used or intended to be used in violation of Florida Statutes Section 932.702; or said property is "contraband" as defined by Florida Statutes Section 932.701(2)(a),. 5. On March 18, 2014, Gretna Police officers seized the property described in Paragraph 3 above in Gadsden County, Florida. 6. Facts sufficient to state a cause of action alleged in Paragraph 5 above and in support of a final judgment of forfeiture are set forth in the verified affidavits of OFFICER CHARLES BROWN and SERGEANT MAXIMILIAN SANDER, the original of which is attached and incorporated herein by Reference. 7. The following person may claim an interest in the property which is the subject of this action: Joseph Wajerski, Tallahassee, Florida. As required by Florida Statutes Section 932.703(2)(a), the Gretna Police Department sent by certified mail a Notice of Forfeiture Proceedings to Mr. Wajerski, a copy of which is attached hereto as Exhibit "A" WHEREFORE, THE CITY OF GRETNA, prays for this Court to enter a Final Order of Forfeiture perfecting the right, title and interest in the property for the use of the Gretna Police Department.
